These Terms & Conditions apply to all puppy purchases from Crystal Creek Kennels Pty Ltd (“Crystal Creek Kennels”, “we”, “us” or “our”).

 

By paying a holding deposit or otherwise proceeding with the purchase of a puppy, the purchaser (“you” or “the purchaser”) acknowledges that they have read, understood and accepted these Terms & Conditions.

 

These Terms & Conditions are intended to operate consistently with all applicable Australian laws, including the Australian Consumer Law (ACL). Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded.

 

1. HOLDING DEPOSIT

 

A minimum holding deposit of 15% of the agreed purchase price is required to secure a puppy.

 

Payment of the holding deposit confirms your intention to proceed with the purchase and allows Crystal Creek Kennels to reserve the puppy for you and remove the puppy from availability to other prospective purchasers.

 

The deposit is non-refundable in circumstances where the purchaser simply changes their mind. However as a gesture of goodwill, we are happy to offer a $500 credit towards a future purchase from Crystal Creek Kennels.

 

Before paying a deposit, purchasers are encouraged to carefully consider their circumstances, including their ability to provide the puppy with appropriate care, accommodation, exercise, veterinary attention and ongoing financial commitment.

 

2. CHANGE OF MIND — RETURN WITHIN 3 DAYS

 

If, after purchasing or placing a holding deposit on a puppy, the purchaser changes their mind for reasons unrelated to the puppy’s health, Crystal Creek Kennels may accept the return of the puppy within three (3) days, subject to the following:

 

* the puppy must be returned to Crystal Creek Kennels;

* the puppy must be in good health and condition;

* the purchaser must provide all relevant documentation and items supplied with the puppy; and

* Crystal Creek Kennels will refund 75% of the purchase price.

 

The remaining 25% may be retained to cover costs associated with the transaction, administration, preparation, reservation of the puppy and the disruption caused by the return.

 

After the three (3) day period, no change-of-mind return or refund will apply, unless otherwise required by applicable law.

 

This clause does not affect any rights the purchaser may have where the puppy has a health issue or where the purchaser has rights under the Australian Consumer Law.

 

3. HEALTH-RELATED RETURN WITHIN 21 DAYS

 

If, within twenty-one (21) days of purchase, the purchaser believes the puppy has a significant health condition that makes the puppy unsuitable for purchase, the purchaser must arrange an examination by a registered veterinary practitioner as soon as reasonably possible.

 

Where the veterinary practitioner provides written documentation supporting the health concern and Crystal Creek Kennels accepts that the condition falls within the applicable health provisions of this agreement, the purchaser may return the puppy to Crystal Creek Kennels.

 

Subject to applicable law and the veterinary evidence provided, Crystal Creek Kennels will provide a 100% refund of the purchase price where the puppy is returned under this provision.

 

The purchaser must provide Crystal Creek Kennels with the relevant veterinary documentation upon request.

 

4. HEALTH GUARANTEE

 

Crystal Creek Kennels takes the health and welfare of its puppies seriously.

 

Where a puppy is diagnosed within three (3) years of purchase with a disease or inherited/genetic condition that is established by appropriate veterinary evidence to have originated from, or be directly attributable to, the breeding undertaken by Crystal Creek Kennels, the matter will be assessed in accordance with these Terms & Conditions and applicable law.

 

Where the evidence establishes that Crystal Creek Kennels is responsible for the relevant condition, Crystal Creek Kennels will provide an appropriate remedy, which may include a refund of the purchase price, subject to the circumstances and requirements of applicable law.

 

Where a puppy dies or is euthanised as a result of a condition claimed to be attributable to Crystal Creek Kennels, the purchaser must provide appropriate veterinary documentation establishing the cause of death or euthanasia and, where reasonably possible, evidence linking the condition to the breeding of the puppy.

 

This health guarantee does not extend to conditions or circumstances arising from:

 

* accidental injury or trauma;

* neglect or inadequate care;

* inappropriate diet or feeding;

* obesity or inadequate exercise;

* failure to follow veterinary recommendations;

* infectious disease contracted after the puppy leaves Crystal Creek Kennels;

* environmental or lifestyle factors;

* failure to provide appropriate preventative veterinary care; or

* conditions unrelated to the breeding or health of the puppy at the time of sale.

 

Nothing in this clause limits any rights or remedies available to the purchaser under the Australian Consumer Law.

 

5. OWNERSHIP

 

The puppy remains the property of Crystal Creek Kennels Pty Ltd until the purchase price has been paid in full.

 

The puppy will not be released to the purchaser until full payment has been received, unless otherwise agreed in writing.

 

Upon receipt of full payment, ownership will transfer to the purchaser, subject to any continuing contractual obligations, including the applicable Non-Breeding Agreement.

 

6. PAYMENT

 

The balance of the purchase price must be paid in full prior to or on the agreed collection date.

 

Crystal Creek Kennels reserves the right to withhold release of the puppy until full payment has been received and cleared.

 

7. COLLECTION OF YOUR PUPPY

 

The purchaser is responsible for collecting their puppy on the agreed collection date.

 

Our standard collection timeframe is approximately eight (8) weeks of age, subject to the puppy’s individual health, development, veterinary requirements and any applicable legal requirements.

 

Any alternative collection arrangement must be agreed with Crystal Creek Kennels in advance.

 

8. LATE COLLECTION & BOARDING

 

Where a puppy remains at Crystal Creek Kennels after the agreed collection date at the purchaser’s request or due to the purchaser’s inability to collect the puppy, a boarding fee of $50 per day will apply.

 

This fee covers the additional costs associated with feeding, accommodation, cleaning, care and handling of the puppy.

 

Any extended boarding arrangement must be discussed and agreed with Crystal Creek Kennels as early as possible.

 

9. NON-BREEDING AGREEMENT

 

All puppies sold by Crystal Creek Kennels are subject to a Non-Breeding Agreement, unless expressly agreed otherwise in writing.

 

The purchaser agrees to comply with the terms and conditions of the applicable Non-Breeding Agreement.

 

The Non-Breeding Agreement forms an important part of the purchase arrangement and should be carefully read before a purchaser commits to purchasing a puppy.

10. WAITING LIST & PUPPY AVAILABILITY

 

Our current estimated waiting period is generally three (3) to six (6) months.

 

Waiting times are estimates only and may vary depending on:

 

* breeding schedules;

* litter size;

* puppy availability;

* demand;

* purchaser preferences;

* gender; and

* coat colour.

 

While we will make every reasonable effort to accommodate your preferences, we cannot guarantee a particular gender, coat colour, litter or timeframe.

 

Where possible, we will work with purchasers to identify a suitable puppy based on their preferences and availability.

 

11. INTERSTATE PURCHASERS

 

Purchasers located outside Victoria are responsible for arranging and paying for the transportation of their puppy from Crystal Creek Kennels.

 

This includes:

 

* transport arrangements;

* collection from our premises;

* travel costs;

* transport insurance where required; and

* any veterinary examinations or documentation required by the selected transport provider.

 

We recommend using an established and reputable pet transport provider. Examples include Jetpets, Dogtainers and Aero Pets.

 

Purchasers should independently confirm the current requirements, costs and conditions of their chosen transport provider before making travel arrangements.

 

Veterinary Travel Clearance

 

Where a puppy is required to travel before eight (8) weeks of age, the selected transport provider may require a veterinary health examination and fit-to-fly clearance.

 

Where such clearance is required, the cost of the veterinary examination and certificate is currently $250, payable by the purchaser.

 

The purchaser is responsible for confirming the transport provider’s requirements before booking travel.

 

12. INTERNATIONAL PURCHASERS

 

International purchasers are responsible for understanding and complying with all requirements applicable to the importation of a puppy into their destination country.

 

Depending on the destination, requirements may include:

 

* minimum age requirements;

* vaccinations;

* microchipping;

* veterinary examinations;

* blood testing;

* import permits;

* quarantine periods;

* government documentation;

* airline requirements; and

* other mandatory procedures.

 

Some countries require puppies to be 12 weeks of age or older, while other countries may impose additional requirements.

 

Because international import regulations vary and can change, purchasers must obtain current information from the relevant government authorities and transport providers.

 

International purchasers should contact Crystal Creek Kennels before placing a deposit so that the proposed arrangements and requirements can be discussed.

 

Unless otherwise agreed in writing, all international transport, veterinary, quarantine, government, airline and associated costs are the responsibility of the purchaser.

 

13. PURCHASER RESPONSIBILITIES

 

Before purchasing a puppy, the purchaser is responsible for ensuring that they are able to provide:

 

* suitable accommodation;

* appropriate food and nutrition;

* regular veterinary care;

* vaccinations and preventative treatments;

* appropriate exercise and socialisation;

* adequate supervision and companionship; and

* a safe and suitable environment for the lifetime of the dog.

 

A puppy is a long-term commitment, and purchasers should carefully consider this commitment before placing a deposit.

 

14. ACCEPTANCE OF THESE TERMS

 

By paying a holding deposit, the purchaser confirms that they:

 

1. have read these Terms & Conditions;

2. understand the conditions of purchase;

3. have had the opportunity to ask Crystal Creek Kennels any questions before proceeding;

4. understand that puppy availability, gender, coat colour and waiting times cannot always be guaranteed; and

5. agree to comply with these Terms & Conditions and any applicable Non-Breeding Agreement.

 

These Terms & Conditions should be read together with any written puppy-specific agreement, invoice, receipt or Non-Breeding Agreement provided by Crystal Creek Kennels.

 

Where there is any inconsistency between these Terms & Conditions and a mandatory requirement of Australian law, the mandatory legal requirement will prevail.
